1. What Does This Privacy Policy Mean?

This Privacy Policy (hereinafter - Privacy Policy) provides information on how the joint-stock company “Linas Agro” processes your personal data.

2. About joint-stock company “Linas Agro”

The joint-stock company “Linas Agro” (hereinafter - Linas Agro), legal entity code: 147328026, registered office address: Smėlynės g. 2C-3, LT-35143 Panevėžys, email: [email protected], is part of the AB Akola Group group of companies and the controller of your personal data.

In some of the following cases, Linas Agro may be a joint controller of your personal data with other company(ies) in the AB Akola Group.

3. What Is Personal Data?

Personal data is any information collected about a data subject by Linas Agro, which may be used for identifying the data subject. Personal data includes any information, including the data subject’s full name, surname, address, IP address, etc.

4. What Kind Personal Data Do We Process and Why?

The Linas Agro process your personal data for the following purpose:

• 1. Linas Agro e-shop administration purposes
     • • • For the purpose of creating and managing your account in the e-shop, Linas Agro processes the following personal data: e-mail address, password, IP address, address, date of registration and consent to receive newsletters, date of last visit; personal information (if provided by the user): name, surname, telephone number, information about the position held and the workplace. This personal data is collected based on concluding and executing the contract and is stored for 3 (three) years from your last login.
         • For the purpose of order fulfillment and e-commerce organization, Linas Agro processes the following personal data: name, surname, telephone number, IP address, purchase history, delivery address, payment details, order-delivery action history, return history, communication with you. These personal data are collected for contract execution and legal obligation (to issue invoices) and are stored for 10 (ten) years from the execution of the sales contract. Your data required for payment is transferred to UAB “Paysera LT”.
         • For the purpose to deliver client’s orders, Linas Agro processes the following personal data: name, surname, telephone number, address, post office information, shipment number. These personal data are processed based on the performance of the contract and stored for 10 (ten) years after the contract's conclusion. For the purpose of order delivery, your personal data may be transferred to courier services, for example, UAB “Venipak Lietuva”, UAB “DPD Lietuva” and others.
         • For the purpose of administrating customers' inquiries / complaints, Linas Agro processes the following personal data: name, surname, e-mail. email address, information in the request / complaint. These personal data are processed based on a legitimate interest in ensuring the quality of services provided and are stored for 2 (two) years from the request's resolution.
  2. For the purpose of self-service management
• In order to enable the Clients to use the services provided by Linas Agro electronically, Linas Agro processes the following personal data for the purpose of self-service management: username, password, account, contract data. These personal data are processed based on your consent, which you express when registering on the self-service portal, and stored for the duration of your contract. The personal data processed for this purpose may be made available to data processors engaged for the performance of programming services.   3. Communication with customers
     • • • If you consent (ordered newsletters, or tick consent box while registering or buying at e-shop, etc) for the purpose of direct marketing Linas Agro will process the following personal data: your name, surname, e-mail address and phone number. This data will be collected based on your consent and stored for 3 (three) years from the date of your consent to receive direct marketing communications. In this case, Linas Agro is the joint controller of your personal data with UAB “Dotnuva Baltic” (legal entity code: 261415970, registered office address: Parko g. 6, LT-58350 Akademijos mstl., Dotnuvos sen.,  Kedainiai district, e-mail address: [email protected]), UAB „GeoFace“ (legal entity code: 304781617, registered office address: Brastos g. 14, LT - 47185 Kaunas, email address: [email protected]) UAB „Dotnuva Rent“ (legal entity code: 161452398, registered office address: Parko g. 6, LT-58350 Akademijos mstl., Dotnuvos sen.,  Kedainiai, e-mail address: [email protected]). Each time you receive a direct marketing message, you will have the option to opt out of direct marketing communications by notifying Linas Agro via email, by post or other specified means. If you have not given your consent for direct marketing, but are a customer of Linas Agro (you have purchased our goods or ordered services in the last two years) on the basis of a legitimate interest to perform direct marketing (Article 69 of the Electronic Communications Law), Linas Agro may send you offers or newsletters regarding similar goods or services. For this purpose, Linas Agro processes the following personal data: name, surname, e-mail. postal address, telephone number. These personal data are processed for 2 (two) years from the date of purchase of goods or services. Each time you receive a message, you will have the option to opt out of direct marketing communications by notifying Linas Agro via email, by post or other specified means.
         • The information that you provide to Linas Agro through social media when you visit our accounts (including messages, use of "Like" fields and other communications) is jointly controlled by us and the operators of the social networks as joint controllers of your personal data. We recommend that you read the privacy notices of third parties and that you contact the providers directly if you have any questions about how they use your personal data.

• 4. Marketing activities
• For the purpose of organising the activities of the marketing team: games, promotions, lotteries, seminars or other activities, Linas Agro processes the following personal data: name, surname, telephone number, e-mail address, residential address, company name, job title, image, additional data may be processed, if necessary, and if you are informed separately. This personal data is processed on the basis of consent and stored for the retention period provided for in the rules governing the promotion, programme or other activity. 
  5. Contracts administration
     • • • For the purpose of assessing the client's ability to perform the contract, Linas Agro processes the following personal data: name, surname, personal identification number, declared and actual residence addresses, declared residence date, telephone number, personal document data (number, date of issue, etc.), information about family situation, number of minor children and dependents, information on available movable and immovable property, data from the real estate register, information from seizure and mortgage registers, credit rating and settlement history. This personal data is processed on a contractual basis. Data that is not necessary for the conclusion of the contract are destroyed after the assessment, and other personal data is stored for 10 (ten) years after the conclusion of the contract. Linas Agro does not collect all the specified data when assessing the ability of customers to perform contracts, the amount of personal data collected depends on the form of the contract and the chosen form of payment (paid immediately or with postponement, etc.).          • For the purpose of concluding and executing purchase, sale, service provision contracts, Linas Agro processes the following personal data: name, surname, personal identification code, personal document data, e-mail, postal address, address of residence, telephone number, marital status, bank account number, VAT payer code, farmer's certificate number, list number of registered feed business operators, data on concluded transactions and their execution. This personal data is processed based on concluding and executing the contract and stored for 10 (ten) years after the expiry of the contract.          • For the purpose of administering the grain purchase process: registering, preparing or sending bills of lading and/or other documents, organising the unloading of the goods or managing other logistical operations, the personal data of the persons responsible for the Contract and/or their partners, agents, service providers will be processed: name, surname, email address, telephone number, position, vehicle data and other data which become known during the Seller's identification or during the execution of this Contract. In case of the need to organise unloading in high security areas, e.g. Klaipėdos jūros krovinių kompanija Bega UAB, additional personal data of the person responsible for the performance of the Contract shall be processed: identification document number, type. The personal data is processed on the basis of the Contract and consent. This personal data is stored for 10 (ten) years after the expiry of the contract.
         • The following personal data is processed to grant payment deferrals to customers: name, surname, bank account number, and payment schedule. These personal data are processed based on the performance of the contract and stored for 10 (ten) years after the expiry of the contract.          • For the purpose of debt administration, Linas Agro processes the following personal data: name, surname, address, date of birth, amount of arrears and circumstances. These personal data are processed based on a legitimate interest in ensuring the performance of contracts and are stored for 10 (ten) years after the performance/expiry of the contract.   6. Administration of customer enquiries

For the purpose of administering enquiries for goods and services on the website, Linas Agro processes the following personal data: name, surname, e-mail address, district, information contained in the enquiry, information on machinery (plough, tractor, etc.), model of machinery, information on the farm/company. These personal data are processed based on a legitimate interest in communicating with customers and stored for 1 (one) year after the request is resolved.

1. 7. When Linas Agro carries out video surveillance

For the purpose of ensuring the security of persons and property (video surveillance), Linas Agro processes the following personal data: images of objects in the field of view, including images of people, their location and movement through areas covered by cameras, belongings carried, behavior and other related information (date and time). This data will be kept for 14 (fourteen) days.

Data subjects are informed about the places where video surveillance is carried out in the area of Linas Agro by means of warning signs.

1. 8. Recruitment

For the purpose of selection of candidates for vacancies Linas Agro processes the following personal data: name, surname, education, work experience and other information provided by the person in his/her CV and motivation letter. This personal data is processed for the legitimate interest of the candidate's selection and based on your consent and is stored for 3 (three) months from the date of recruitment.

If you are not selected for further selection, the CV shall be stored only with your separate consent and, in the absence of consent, shall be destroyed within 1 (one) month of the end of the selection process.

1. 9. Verification of compliance with international sanctions and restrictive measures

Due diligence on business partners requires the completion of a Business Partner Familiarisation Questionnaire and Business Partner Declaration. For this purpose, Linas Agro processes the following personal data: name, surname, position, signature of the person acting on behalf of the business partner: name, surname, date of birth, nationality, address of residence, telephone number, e-mail address, address of the legal entity, the name, surname, nationality, date of birth, the name, surname, date of birth, shareholder: name, surname, date of birth, amount of shares, the ultimate beneficiary: name, surname, date of birth, nationality, percentage of ownership, and the personal data contained in the copies of the documents requested. In addition, information on the Data Subjects included in the verification is collected from publicly available information sources, including but not limited to public registers, public media and other sources.

The personal data referred to above are processed on the basis of legitimate interest for the purpose of knowing our partners and are kept for a minimum of 5 (five) calendar years from the end of the verification being carried out and the end of the verification being carried out.

For the processing of personal data Linas Agro has used the data processing tool of the Data Processor UAB "iDenfy" (legal entity code 304617621, address Kaunas, Gričiupio g. 7-212, LT-51372 Kaunas).

1. 10. In the implementation of statutory obligations related to the organisation of activities

In order to ensure the proper implementation of obligations, Linas Agro processes the following personal data of shareholders, members of the management body, final beneficiaries and other interested persons: name, surname, personal identification number, place of residence, date of election, copy of the final beneficiary's passport, information on the participation of the permanent beneficiary and his/her close relatives in the political activity, personal data contained in the decisions of the Board of Directors and the General Shareholders' Meeting, protocols and authorisations. Personal data are processed in the exercise of a legal obligation or legitimate interest and, in individual cases, on the basis of consent.

Personal data processed for this purpose shall be kept for the period provided for by law.

1. 11. For the implementation of statutory obligations related to the detection of violations and sustainability

Ensuring adequate protection of whistleblowers, prevention of corruption, implementation of equal opportunities, protection of human rights and other sustainability factors, Linas Agro processes the following personal data of the persons concerned: name, surname, telephone number, e-mail address, content of the notification or other informative text, evidence of the violation provided by you: video and/or audio recordings, photo, screenshot, communication, etc. Personal data is processed in order to comply with a legal obligation or legitimate interest. Personal data processed for this purpose shall be kept for the time prescribed by law.

6. Who can we disclose your personal data to?

We may disclose information about you to our employees, intermediaries, service providers, such as debts administrators or debt recovery companies, archiving service providers, marketing services, IT service providers or subcontractors, if necessary for the purposes set forth in this Privacy Policy.

We may also transfer your data for the purpose of internal administration, on the basis of the Joint Managers Agreement or with your consent, within the group of companies of the AB Akola Group (UAB “Dotnuva Baltic”, UAB “GeoFace”, UAB “Dotnuva Seeds”, UAB “Dotnuva Rent etc.). The joint data controllers have contractually defined the obligations applicable to the parties and will process the personal data received in accordance with the applicable personal data protection requirements.

We may disclose your personal data to data processors who provide us with services (perform work), i. e. IT service providers, auditors, lawyers, consultants, and process your data on behalf of Company as a data controller.

Data processors will be allowed to process your personal data solely based on our instructions and only to the extent necessary. We will take all necessary steps to ensure that our data processors implement the appropriate organizational and technical measures to ensure safety and confidentiality of your personal data.

Your data may also be transferred to public bodies or institutions or other persons who are statutorily entrusted with certain functions.

In addition, we may disclose your information in the following cases:

• In order to protect our rights or interests (including the case when your personal data is disclosed to others for debt recovery purposes);
• When intending to sell any of the Company’s business or assets, we are asked to disclose your personal data to potential buyers of such business or assets.

In order for you to understand how we use your personal data and to suffer no inconvenience on that account, you may contact us at any time to ask whether any of your personal data is processed by us. If your personal data is stored or used by us in whatever way, you have the right of access to such data. In order for you to exercise such right, please send us your written request at the e-mail address given in this Privacy Policy. We may ask you to confirm your identity in order to grant your request, which should be submitted by you acting reasonably and in good faith.

If you contact us, we may process the data you provide to us, i.e. name, surname, email address, telephone number, date and text of the correspondence in accordance with the procedures set out in this Privacy Policy. Please note that we may need to contact you by post, email or telephone. Please notify us of any changes to your personal data.

If having received your request, complaint or claim we have doubts about your identity, we may ask for your identity document.

If we fail to provide you with the necessary information and/or should you have complaints about how your personal data are processed, you may approach Lithuanian State Data Protection Inspectorate (www.vdai.lrv.lt) by filing a complaint.

You are responsible for the confidentiality of your or your children’s data submitted and for ensuring that such data is accurate, correct and complete. You should inform us immediately by e-mail if changes are made to the data you have submitted. Therefore, we will not be held liable for damage resulting from your failure to provide correct or complete personal data or to give us notice of changes made to such data.
